We are pleased to announce that the domain name camerimage.com<\/b>, has been transferred to its legitimate owner – Tumult Foundation<\/b>, the organizer of the International Film Festival of the Art of Cinematography Plus Camerimage<\/b>. <\/p>\n
The domain name camerimage.com was registered in 2002 and was created with the unauthorized use of the name (trademark) \u201cCamerimage”. After six years of unsuccessful attempts to reclaim the domain name (negotiations with illegitimate “owner”, legal proceedings before Polish court) , this year, we decided to file a complaint to Arbitration and Mediation Center<\/b> at World Intellectual Property Organization (WIPO)<\/b>, with its seat in Geneva. Due to the WIPO arbitration panel\u2019s decision, the ownership of the domain was transferred and is now administered by the Tumult Foundation. On visiting www.camerimage.com an internet user is directed to the official website of Plus Camerimage Festival. <\/p>\n
The decision was based on the findings that the word \u201cCamerimage” is a word invented and created by Mr. Marek \u017bydowicz the founder the creator of Plus Camerimage Festival; the word has no equivalents and other associations in any language. It has been used as a name for 15 years and it has become a distinctive identifier associated with the Festival. The Panel has also concluded that the Respondent was not in any way authorized to use a trademark \u201cCamerimage” and that the domain was registered and was being used in bad faith. <\/p>\n
The name \/ trademark CAMERIMAGE is given by some patent agent as a model example of the integrity of a trade mark, which is associated only with the meaning it was created for. <\/p>\n
